How KSMM Pty Ltd handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
KSMM Pty Ltd (ABN 93 699 859 375, ACN 699 859 375) (“KSMM”, “we”, “us”) respects your privacy. This policy explains what personal information we collect, why we collect it, how we hold and use it, and how you can access, correct or complain about it.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act. This policy applies to this website, ksmmtec.site, and to our dealings with clients, suppliers and enquirers.
1. The information we collect
We collect only the personal information reasonably necessary for our business functions and activities. That ordinarily includes:
- Contact and identity details — your name, business name, email address, and any postal or site address you give us;
- Enquiry and engagement information — the details of the work you ask us about, the site involved, timeframes, and the correspondence between us;
- Transaction records — quotes, purchase orders, invoices, payment records and the supporting documents for an engagement;
- Supplier information — contact details and credentials for suppliers and contractors we engage on a client's behalf.
We do not seek sensitive information as defined in the Privacy Act, and we ask that you do not send it to us. If sensitive information is provided unsolicited and we are not permitted to keep it, we will destroy or de-identify it where lawful to do so.
2. How we collect it
We collect personal information directly from you wherever it is reasonable and practicable to do so — when you email us, submit the enquiry form on this website, or deal with us in the course of an engagement. Where we need information about a site or a job from a third party, such as a supplier, a carrier or a building manager, we collect only what is necessary for the engagement.
The enquiry form on our contact page does not transmit data to this website or store it here. It opens a message in your own email program addressed to us; the information reaches us only when you choose to send that message.
3. Why we collect and use it
We collect, hold and use personal information for the following purposes:
- to respond to enquiries and prepare written quotes;
- to deliver, coordinate, supply and administer the services we have been engaged to provide;
- to arrange purchases, freight and supplier attendance on your behalf;
- to invoice, take payment and maintain financial records;
- to keep the job and compliance records described in our services, and to respond to insurer, auditor or head-contractor requests you have authorised;
- to meet our obligations under Australian law.
If you choose not to give us the information we ask for, we may be unable to quote or carry out the work.
4. Disclosure
We do not sell personal information, and we do not disclose it for any purpose unrelated to the one for which it was collected unless you would reasonably expect it, you have consented, or the law requires or authorises it.
We may disclose personal information to:
- suppliers, carriers, contractors and trades engaged to deliver part of your work — limited to what they need to perform it;
- our accountants, insurers and professional advisers;
- a court, regulator or government agency where required or authorised by law.
5. Overseas recipients
Our records are held in Australia wherever practicable. Some ordinary business software we use — including email and website hosting — may store or process data on servers located outside Australia. Before disclosing personal information to an overseas recipient we take steps that are reasonable in the circumstances, in accordance with APP 8, to ensure the recipient handles that information consistently with the Australian Privacy Principles.
6. Direct marketing
We do not run marketing lists or send bulk promotional email. If we ever contact you about a service you have not asked about, the message will identify us and give you a simple way to opt out, and we will act on that request promptly. You may tell us at any time that you do not wish to receive such contact by writing to [email protected].
7. Cookies and this website
This website consists of static pages. It does not set advertising or analytics cookies, does not run third-party tracking scripts, and does not build a profile of your browsing.
Our hosting provider may record standard technical information — such as the IP address making a request, the page requested, the time of the request and the browser type — in server logs used for security, abuse prevention and reliability. This information is not used to identify individual visitors. Most browsers let you block or delete cookies through their settings; doing so will not affect your use of this site.
8. Security and retention
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to the people who need it, using reputable providers for email and file storage, and applying access controls to our records.
We keep engagement, financial and job records for as long as we need them for the purpose we collected them and for as long as Australian law requires records of that kind to be retained. When information is no longer needed and we are not required to keep it, we destroy or de-identify it.
If a data breach occurs that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner where required.
9. Accessing and correcting your information
Under APP 12 and APP 13 you may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
Write to [email protected] with enough detail to let us find the records and verify who you are. We will respond within a reasonable period, ordinarily within 30 days, and we do not charge a fee for making a request. If we refuse access or a correction, we will tell you why in writing and explain how to complain.
10. Complaints
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please tell us first. Write to [email protected] setting out what happened. We will acknowledge your complaint, investigate it and respond in writing, ordinarily within 30 days.
If you are not satisfied with our response, you may refer the complaint to the Office of the Australian Information Commissioner (OAIC), the independent regulator responsible for privacy in Australia. The OAIC can be contacted through its website at oaic.gov.au or by telephone on 1300 363 992.
11. Changes to this policy
We may update this policy as our practices or the law change. The current version is always the one published on this page, with the date shown at the top. Material changes will be reflected here before they take effect.
